justice and equality sponsors

 Having gone through, of course, more literature/ materials in the recent past on this issue, I think, unfortunately, most of the legal fraternity, biologists, social engineering enthusiasts, so- called justice and equality sponsors and the religious zealots and political hunters, all alike have taken the argument from their perspectives ( euphemistically we may brand them as a wide spectrum of perspectives).


Everyone has become too emotionally involved, agitated and hence resorted to uttering terminologies usually not considered very parliamentary in public domain ( in countries like India).

The matter itself came to the court because certain sections of the human beings have been ostracized, deprived of various social benefits just because they have been born or chose an orientation considered not fitting into the stereotyped gender perceptions perceived over centuries. 

I am not saying either it is right or wrong. It may involve biological features or not. Sometimes, it may be just orientation or characteristics. 

But whatever may be the case, just because some are either born with mixed biological features or acquire an orientation different from the ones expected by the majority of the society, it does not mean that they can be deprived of various opportunities, leave alone benefits and privileges that the other genders enjoy.

This,like abortion, abolition of slavery, racism, caste discriminations and many other social taboos needed to be addressed and justice done to the LGBT  communities. 

This was a social engineering which got delayed all these years, but cannot be postponed forever. 

Probably to get the extreme reactions and responses the CJI may have used such terminologies. 

Now, almost, most of the reactions indicate centuries of entrenched biases and not any real scientific or social objection.

Ultimately, law will be enacted to address the issue . This may have various repercussions and involve changing a lot of other legal rules and acts, so be it, after all, any judiciary or democratically elected legislature is there to effect the necessary social engineering that goes to enhance the status of the society to be more inclusive and cosmopolitan in nature and in  practice. 

Just because for centuries, some status has been there, it does not mean that it has to continue.
